The Supreme Court will hear a lawsuit on October 22 filed by 16 state governments challenging the constitutionality of the Economic and Financial Crimes Commission (EFCC) and two other entities.
A seven-justice panel, led by Justice Uwani Abba-Aji, set this date after allowing states to join as co-plaintiffs in a case consolidated with Kogi Government’s original suit.
The states argue that the EFCC Establishment Act violates the 1999 Constitution since it was not appropriately adopted by state assemblies, as required.
They claim that any legislation not endorsed by states cannot enforce laws, rendering the institutions illegal. During the proceedings, states expressed differing interests regarding co-plaintiff status and case consolidation.
The Kogi government seeks declarations asserting that federal agencies lack authority over state funds. The case is adjourned until October 22 for further hearing.
